MAINTENANCE ACT 1965 - SECT 117
Applications to be in writing
117 Applications to be in writing
(1) An application to a court for the purposes of this Act shall be in writing
made to the court at which the application is, by the application, set down
for hearing.
(2) Except where an ex parte application may be made under this
Act, the court may, after service of notice of the application upon such
persons as appear to the court to be affected by the application, proceed to
hear the application whether or not any person to whom any such notice has
been issued is present at the hearing.
(3) Any person on whom any such notice
has been served shall be entitled to be heard and may be represented by
counsel or solicitor, and may examine and cross-examine the witnesses giving
evidence for or against the person respectively.
