22 Magistrates Courts
(1) A Magistrates Court may dismiss a complaint for a simple offence if the
court is reasonably satisfied, on the balance of probabilities, that the
person charged with the offence was, or appears to have been, of unsound mind
when the offence was allegedly committed or is unfit for trial.
(2) A
Magistrates Court may also order that a person appearing before the court be
examined by an authorised doctor to decide whether to make a
treatment authority for the person or to make recommendations about the
person’s treatment and care.
