Dissatisfied party may elect to continue
343 Dissatisfied party may elect to continue
(1) A party who is dissatisfied
with a case appraiser’s decision may elect to have the dispute go to trial
or be heard in the ordinary way by filing an election in the approved form
with the registrar.
(2) The election must be filed within 28 days after the
case appraiser’s certificate is filed in the registry.
(3) If an election
is filed— (a) the case appraiser’s decision has no effect other than as
provided by rule 344 ; and
(b) the dispute must be decided in a court as if
it had never been referred to the case appraiser.
