Joint or several liability
64 Joint or several liability
(1) If a plaintiff or applicant seeks relief against a defendant or respondent
who is liable jointly with another person and also liable severally, the other
person need not be made a defendant or respondent to the proceeding.
(2) If
persons are liable jointly, but not severally, under a contract, and a
plaintiff or applicant seeks relief in relation to the contract against some
but not all of the persons, the court may stay the proceeding until the other
persons liable under the contract are included as defendants or respondents.
