UNIFORM CIVIL PROCEDURE RULES 1999 - REG 881
Money in court
881 Money in court
(1) This rule applies if the enforcement debtor is
entitled in the enforcement debtor’s own right to money in court standing to
the enforcement debtor’s credit in another proceeding in the court.
(2) The
court may, on the application of an enforcement creditor, order that the money
be applied towards satisfying the money order.
(3) Money in court standing to
the credit of an enforcement debtor may not be paid out if it appears to the
court that an application under subrule (2) has been made.
(4) An application
under this rule must be made in the proceeding in which the order being
enforced was made.
