Procedure after arrest
940 Procedure after arrest
(1) A person who enforces a warrant for the
arrest of a defendant must, as soon as practicable after enforcing it, take
the defendant to the nearest suitable prison.
(2) The person in charge of the
prison must hold the defendant in custody and within 24 hours, or as soon as
practicable afterwards, bring the defendant before the court.
(3) A warrant
on which the time and place of enforcement is written is sufficient authority
for the officer in charge of the prison to hold the defendant in custody.
