WATER RESOURCE (WHITSUNDAY) PLAN 2010 - REG 68

68 Taking water using particular existing overland flow works authorised

(1) This section applies to the owner of land on which existing overland flow works are situated, other than works for taking only the overland flow water that may be taken under section 67 (2) (a) to (e) .

(2) The owner may continue to use the existing overland flow works to take overland flow water for 1 year after the plan notification day.

(3) Also, if the owner gives the chief executive notice of the existing overland flow works, in the approved form, and any further information reasonably required by the chief executive about the works, the owner may continue to use the works to take overland flow water after the notice and information are given.

(4) However, the authorisation under subsection (3) ceases to apply if the owner is granted a water licence relating to the works.
