ENVIRONMENTAL PROTECTION AND OTHER LEGISLATION AMENDMENT ACT 2005 No. 53 - SECT 47

(1) Section 162(3) and (4)--

renumber as section 162(4) and (5).

(2) Section 162--

insert--

'(3) However, an EIS must not be required for the application if--

(a) it is for an environmental authority (mining lease); and

(b) a relevant mining lease is, or is included in, a significant project.6'.

(3) Section 162(5), as renumbered, definition required period, paragraph (b), 'EPA Minister'--

omit, insert--

'administering authority'.
