General power to enter places
55 General power to enter places
(1) An inspector may enter a place if— (a) an occupier at the place consents
under sub division 2 to the entry, and section 59 has been complied with for
the occupier; or
(b) it is a public place and the entry is made when the
place is open to the public; or
(c) the entry is authorised under a warrant
and, if there is an occupier of the place, section 66 has been complied with
for the occupier; or
(d) it is a workplace and, when the entry is made— (i)
the workplace is open for carrying on business; or
(ii) work is being carried
out at the workplace; or
(iii) the workplace is required to be open for
inspection under a condition of a licence.
(2) If the power to enter arose
only because an occupier of the place consented to the entry, the power is
subject to any conditions of the consent and ceases if the consent is
withdrawn.
(3) If the power to enter is under a warrant, the power is subject
to the terms of the warrant.
(4) An entry may be made under subsection (1)
(d) with or without the consent of an occupier.
