BUILDING FIRE SAFETY REGULATION 2008 No. 160 - SECT 52

52 Maintenance of prescribed fire safety installations--no relevant or appropriate AS

(1) This section applies to a person carrying out maintenance of a prescribed fire safety installation mentioned in schedule 1, column 1 if--

(a) carrying out the maintenance in compliance with the relevant current standard would adversely affect the installation; and
(b) either of the following apply--
(i) there is no relevant former standard for the installation;
(ii) there is a relevant former standard for the installation but carrying out the maintenance in compliance with the standard would adversely affect the installation.

(2) The person must carry out the maintenance of the installation--

(a) if the manufacturer of the installation has made recommendations about the maintenance of the installation--in a way that is consistent with the recommendations; or
(b) if paragraph (a) does not apply--in a way that is reasonably appropriate in the interests of safety.

Maximum penalty--30 penalty units.
