TRANSPORT (RAIL SAFETY) REGULATION 2010 No. 167 - SECT 30

30 Explanation of div 10

(1) This division--

(a) categorises notifiable occurrences as either a category A notifiable occurrence or category B notifiable occurrence; and
(b) prescribes, for section 93(1) of the Act, the period within which, and the way, a rail transport operator must report a category A notifiable occurrence or category B notifiable occurrence.

(2) This division does not prescribe any accidents or incidents associated with railway operations to be notifiable occurrences for schedule 3, definition notifiable occurrence, paragraph 1(b) of the Act.

(3) An accident or incident mentioned in section 31(a) to (h) is a category A notifiable occurrence only if it is a notifiable occurrence within the meaning of schedule 3, definition notifiable occurrence, paragraph 1(a) of the Act.

Example for subsection (3)--
Section 31(e) mentions a fire or explosion on or in rail infrastructure or rolling stock that affects the safe carrying out of railway operations or that has endangered 1 or more persons. The fire or explosion is a category A notifiable occurrence only if the fire or explosion has caused, or could have caused, significant property damage, serious injury or death.

(4) An accident or incident mentioned in section 32(1)(a) to (r) is a category B notifiable occurrence only if it is a notifiable occurrence within the meaning of schedule 3, definition notifiable occurrence, paragraph 1(a) of the Act.

Example for subsection (4)--
Section 32(1)(m) mentions a fire or explosion that either causes damage to rail infrastructure or rolling stock or disrupts the operation of, or results in the closure of, a railway. The fire or explosion is a category B notifiable occurrence only if the fire or explosion has caused, or could have caused, significant property damage, serious injury or death. However, if the fire or explosion has caused significant property damage, serious injury or death, it would be a category A notifiable occurrence under section 31(a) and is therefore not a category B notifiable occurrence because of section 32(2).
