The Parliament of South Australia enacts
as follows:
This Act may be cited as the Local Government (Public Place
Amenity) Amendment Act 2006.
In this Act, a provision under a heading referring to the
amendment of a specified Act amends the Act so specified.
Part 2—Amendment of Local Government Act 1999
3—Amendment of section 254—Power to make orders
Section 254(1), table—after clause 4 of
the table insert:
5. Public place amenity |

To plant and maintain specified types of trees or other
vegetation in specified areas within a public place. |
The public place has an area greater than the area prescribed by
regulation and the trees or other vegetation— (a) would
substantially improve the amenity of the public place or would enhance the
public's enjoyment of the public place; and (b) would
not substantially detract from the owner's or occupier' s use of the public
place. |
The owner or occupier of the land. |
