The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Landscape South Australia (Miscellaneous) Amendment Act 2020.

2—Commencement

(1) Subject to subsection (2)


, this Act comes into operation on the day on which it is assented to by the Governor.

(2) Section 4


will be taken to have come into operation on 1 July 2020.

3—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Landscape South Australia Act 2019

4—Amendment of section 88—Declaration of penalty in relation to unauthorised or unlawful taking of water

(1) Section 88(6)—after "section 76" insert:

(subject to such modifications as are necessary to give effect to this section and such other modifications (if any) as may be prescribed by the regulations)

(2) Section 88(7)—delete subsection (7) and substitute:

(7) In this section—

accounting period means the period determined by the Minister from time to time by notice in the Gazette (with the period not necessarily being the same period as the accounting period under Division 2);

consumption period in relation to an accounting period means a period of approximately the same length as the accounting period that commences or terminates during the accounting period and during which water is taken or used.

5—Amendment of Schedule 4—The Water Register

Schedule 4, clause 10—delete the clause
