This Act may be cited as the Road Traffic (School Bus Seat
Belts) Amendment Act 2006.
This Act will come into operation on
In this Act, a provision under a heading referring to the
amendment of a specified Act amends the Act so specified.
Part 2—Amendment of Road Traffic Act 1961
After section 162A insert:
162AB—Seat
belts and school buses
(1) A
person must not drive a school bus unless it has seat belts that comply with
the applicable Australian Standard and anchorages for seat belts that comply
with the applicable Australian Standard installed, in accordance with the
applicable Australian Standard, in all seating positions for passengers in the
bus.
(2) A
person must not drive a school bus unless the person has taken reasonable steps
to ensure that each school student under the age of 16 years who is a passenger
in the bus is wearing a seat belt properly adjusted and fastened.
(3) The
regulations may define what constitutes the taking of reasonable steps for the
purposes of subsection (2).
(4) In this section—
school bus means a bus that is used mainly to carry school students
or is undertaking a particular trip mainly for the purpose of carrying school
students;
school student means a student at a primary or secondary school.
