173A—Defence relating to registered owner or operator
(1) In proceedings for
an offence against this Act in which a person is charged as a registered owner
of a vehicle, it is a defence if the person proves—
(a) that
before the relevant time the ownership of the vehicle had been transferred to
some other specified person; or
(b) that
the person was wrongly registered or recorded as an owner of the vehicle.
(2) In proceedings for
an offence against this Act in which a person is charged as the
registered operator of a vehicle, it is a defence if the person proves that at
the relevant time the person was not principally responsible for the operation
or use of the vehicle.
