ENVIRONMENTAL MANAGEMENT AND POLLUTION CONTROL AMENDMENT (EPA INDEPENDENCE) BILL 2021 (Brought in by Rosalie Ellen Woodruff MP) A BILL FOR An Act to amend the Environmental Management and Pollution Control Act 1994 to provide for the independence of the Environmental Protection Authority Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Environmental Management and Pollution Control Amendment (EPA Independence) Act 2021. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Principal Act In this Act, the Environmental Management and Pollution Control Act 1994* is referred to as the Principal Act. *No. 44 of 1994 [Bill ] 3

 


 

Environmental Management and Pollution Control Amendment (EPA Independence) Act 2021 Act No. of 2021 s. 4 4. Section 14A inserted After section 14 of the Principal Act, the following section is inserted in Division 1 of Part 2: 14A. Authority not subject to direction or control of Minister The Authority is not subject to the direction or control of the Minister in respect of the performance or exercise of its functions or powers. 5. Sections 15, 15A, 15B and 15C repealed Sections 15, 15A, 15B and 15C of the Principal Act are repealed. 6. Repeal of Act This Act is repealed on the three hundred and sixty fifth day from the day on which all of the provisions of this Act commence.
