GUARDIANSHIP AND ADMINISTRATION AMENDMENT BILL 2006 (Brought in by the Minister for Justice and Workplace Relations, the Honourable Steven Kons) A BILL FOR An Act to amend the Guardianship and Administration Act 1995 Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Guardianship and Administration Amendment Act 2006. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Principal Act In this Act, the Guardianship and Administration Act 1995* is referred to as the Principal Act. *No. 44 of 1995 [Bill 20] 3

 


 

Guardianship and Administration Amendment Act 2006 Act No. of s. 4 4. Section 65 amended (Emergency orders) Section 65 of the Principal Act is amended as follows: (a) by inserting the following subsection after subsection (4): (4A) The powers and functions of the Board under this section may be exercised and performed by one or 3 members of the Board as may be determined in each case by the President. (b) by inserting the following subsection after subsection (5): (6) A power or function under this section that has been exercised or performed, or purportedly exercised or performed, by any member or members of the Board before the commencement of the Guardianship and Administration Amendment Act 2006 is taken to have been validly exercised or performed by the Board. 4 Government Printer, Tasmania
