NATURE CONSERVATION AMENDMENT (BRUSHY
CREEK CONSERVATION AREA) BILL 2021

A BILL FOR
An Act to amend the Nature Conservation Act 2002 in order to
establish the Brushy Creek Conservation Area
Be it enacted by Her Excellency the Governor of Tasmania, by and with
the advice and consent of the Legislative Council and House of
Assembly, in Parliament assembled, as follows:
1. Short title
This Act may be cited as the Nature Conservation
Amendment (Brushy Creek Conservation Area) Act 2021.
2. Commencement
This Act commences on the day on which this Act
receives the Royal Assent.
3. Principal Act
In this Act, the Nature Conservation Act 2002* is
referred to as the Principal Act.
4. Section 25A inserted
After section 25 of the Principal Act, the following section
is inserted in Part 3:

25A. Brushy Creek Conservation Area established
The provisions set out in Schedule 1A have the
same effect as if they were contained in a
proclamation under section 11(2) of this Act.
5. Schedules 1A and 1B inserted
The following Schedules are inserted after Schedule 1 to
the Principal Act:
SCHEDULE 1A - BRUSHY CREEK CONSERVATION
AREA
All that area of land comprising about 70.16
hectares as shown bounded by heavy black lines
in the Folio Plan issued pursuant to the Land
Titles Act 1980 for the title reference 14862/1, a
reduced copy of which is set out, by way of
illustration only, in Schedule 1B, is to be reserved
land in the class of conservation area and -
(a) the name Brushy Creek Conservation
Area is given to that reserved land;
and
(b) this reservation is to take effect on
the day on which it is registered
under section 22.

6. Repeal of Act
This Act is repealed on the three hundred and sixty fifth
day from the day on which all of the provisions of this Act
commence.
