CRIMINAL CODE AMENDMENT (INTERFERENCE WITH WAR MEMORIALS) BILL BILL 10 OF 2014

                 CLAUSE NOTES

 Criminal Code Amendment (Interference with War
               Memorials) Act 2014

Clause 1:   Short Title

Clause 2:   Commencement on Royal Assent

Clause 3:   Principal Act is the Criminal Code Act 1924

Clause 4:   Amends Schedule 1 of the Principal Act to
            insert a new section 273A. The new section:
                creates a crime of "Interfering with a war
                  memorial"
                defines "interfere". There are different
                  definitions depending on whether the
                  interference relates to a "war memorial"
                  or "war memorial area".
                defines "multi-purpose building" This
                  phrase is used in the definitions of "war
                  memorial" and "war memorial area". An
                  example of a "multi-purpose building" is a
                  memorial hall which is both a memorial
                  and is used for general activities, such as
                  dances, meetings and the like.
                defines "outdoor memorial area". This
                  includes an area with more than one
                  purpose, such as a memorial which is also
                  a public park.
