IRRIGATION COMPANY (CONSEQUENTIAL AMENDMENTS) BILL

CLAUSE NOTES
Clause 1 The Short title of the Act is the Irrigation Company (Consequential
Amendments) Act 2011.
Clause 2 The provisions of the Act commence on the transfer day, as defined
in the Irrigation Company Act 2011.
Transfer day is currently set for 1 July 2011 but may be amended,
by notice, under the Irrigation Company Act 2011.
Clause 3 This Act provides for consequential amendments to legislation
arising from the introduction of the Irrigation Company Act 2011, as
specified in Schedule 1.
Clause 4 This Act provides for consequential amendments to legislation
arising from the introduction of the Irrigation Company Act 2011, as
specified in Schedule 2.
SCHEDULE 1- CONSEQUENTIAL AMENDMENTS
Constitution Act 1934
Clause 1 This clause replaces reference to the Rivers and Water Supply
Commission with Tasmanian Irrigation Pty Ltd.
Meander Dam Project Act 2003
Clause 1 The definition of "Commission" is removed to reflect that the Rivers
and Water Supply Commission will be dissolved on the
establishment of Tasmanian Irrigation Pty Ltd.
The definition of "responsible entity" is amended to remove
reference to the Rivers and Water Supply Commission and replace
it with Tasmanian Irrigation Pty Ltd (ACN 133 148 384).
State Service Act 2000
Clause 1 This clause removes reference to `Rivers and Water Supply
Commission' from Schedule 1 as the Commission will be dissolved
on establishment of Tasmanian Irrigation Pty Ltd.

Tasmanian Public Finance Corporation Act 1985
Clause 1 This clause extends the definition of a "participating authority" to
include Tasmanian Irrigation Pty Ltd to enable it to utilise the
Tasmanian Public Finance Corporation's borrowing facilities, as
prescribed in section 15 of the Irrigation Company Act 2011.
War Service Land Settlement Act 1950
Clause 1 This clause replaces reference to the Rivers and Water Supply
Commission with Tasmanian Irrigation Pty Ltd.
SCHEDULE 2- CONSEQUENTIAL AMENDMENTS
Government Business Enterprises Act 1995
Clause 1 This clause removes reference to `Rivers and Water Supply
Commission' from Part 1 of Schedule 1 as the Commission will be
dissolved on repeal of the Rivers and Water Supply Commission Act
1999.
Schedule 1 specifies statutory authorities that are Government
Business Enterprises.
Clause 2 This clause removes reference to `Rivers and Water Supply
Commission' from Schedule 2 as the Commission will be dissolved
on repeal of the Rivers and Water Supply Commission Act 1999.
Schedule 2 specifies Government Business Enterprises that are
liable to pay tax equivalents.
Clause 3 This clause removes reference to `Rivers and Water Supply
Commission' from Schedule 3 as the Commission will be dissolved
on repeal of the Rivers and Water Supply Commission Act 1999.
Schedule 3 specifies Government Business Enterprises that are
liable to pay guarantee fees.
Clause 4 This clause removes reference to `Rivers and Water Supply
Commission' from Schedule 4 as the Commission will be dissolved
on repeal of the Rivers and Water Supply Commission Act 1999.
Schedule 4 specifies Government Business Enterprises that are
liable to pay dividends, interim dividends and special dividends.
