MOTOR ACCIDENTS (LIABILITIES AND COMPENSATION) AMENDMENT BILL BILL 4 OF 2019

                                   CLAUSE NOTES

           Motor Accidents (Liabilities and Compensation) Amendment Bill



Clause 1        Short Title
                Clause 1 is a formal provision specifying the title of the proposed Act.


Clause 2        Commencement
                Clause 2 is a formal provision specifying that the Bill will commence on the day
                it receives Royal Assent.


Clause 3        Principal Act
                Clause 3 identifies that the amendments contained in the Bill relate to the Motor
                Accidents (Liabilities and Compensation) Act 1973.


Clause 4        Section 28 amended (Determination as to right to scheduled benefits)
                Clause 4 inserts an explicit regulation-making power to allow for the prescription
                of procedures for the hearing and determining of a matter referred to the
                Tribunal.
                Section 28(8)(c)(ii) is amended to clarify that regulations may be made in
                relation to all aspects of costs to be paid by a party to a reference to the
                Tribunal.
                Section 28(9) is inserted to validate any previous determination of the Tribunal
                and any order as to costs made by the Tribunal.


Clause 5        Section 34 amended (Regulations)
                Clause 5 specifically provides that the regulation-making power under section
                34(3) of the Act also applies to the Tribunal.


Clause 6        Repeal of Act
                Clause 6 is a formal provision that is included in all Amendment Bills.
