POISONS AMENDMENT BILL (NO. 2) 2009 CLAUSE NOTES Clause 1 Short Title Clause 2 Commencement This clause provides for the Act to commence on Royal Assent. Clause 3 Principal Act This clause provides that the principal Act being amended is the Poisons Amendment Act 1971 Clause 4 Section 26 amended (Sale and supply of potent substances and hazardous medicinal poisons) This clause provides that the restrictions to the sale and supply of potent and hazardous medicinal poisons under section 26 of the principal Act is subject to the provisions of the newly inserted section 47A. Clause 5 Section 47 amended (Sale and supply of narcotic substances, prohibited plants, and prohibited substances) This clause provides that the restrictions to the sale and supply narcotic substances, prohibited plants, and prohibited substances under section 47 of the principal Act is subject to the provisions of the newly inserted section 47A. Clause 6 Section 47A inserted This clause provides that, despite the restrictions on the sale and supply of medicinal poisons, potent substances, restricted substances and narcotic substances in sections 26 and 47 of the principal Act, the Regulations may enable some persons in some circumstances to administer certain substances on prescribed conditions. POISONS AMENDMENT BILL (NO. 2) 2009 Clause 7 Part 5A renumbered This clause provides that Part 5A of the principal Act is renumbered Part VB. This is because the principal Act already contains a Part VA. Clause 8 Sections 59A to 59G renumbered This clause provides that the sections numbered 59A to 59G in Part 5A are to be renumbered. Clause 9 Section 59G amended (Interpretation) The clause provides for a reference to a renumbered section to be amended. Clause 10 Schedule 1 amended (Membership of Poppy Advisory and Control Board) The clause provides for a number of references to renumbered sections to be amended. Clause 11 Schedule 2 amended The clause provides for a number of references to renumbered sections to be amended. Clause 12 Repeal of legislation This clause provides that the Poisons Amendment Act (No. 2) 2009 will be repealed on the ninetieth day from the day on which it commences. Page 2
