CLAUSE NOTES Workers Rehabilitation and Compensation Amendment (Presumption of Cause of Disease) Bill 2017 Clause 1: Short title Specifies the name of the proposed Act. Clause 2: Commencement Specifies that the Act commences on the day it receives the Royal Assent. Clause 3: Principal Act Specifies that the Workers Rehabilitation and Compensation Act 1988 is referred to as the Principal Act. Clause 4: Section 27 amended (Presumption as to cause of certain diseases in relation to firefighters) Amends Section 27 of the Principal Act by removing all references to the requirement for volunteer fire-fighters to attend a specified number of exposure events. The Section will also specify that volunteer fire-fighters diagnosed with a disease which occurs between 30 October 2013 and 30 October 2017 will be subject to the exposure event requirement. If the disease occurs on or after 31 October 2017 onwards, the new provisions will apply. Clause 5: Section 162A inserted (Review in relation to presumption in respect of PTSD in relation to certain workers) Inserts a new provision into the Act, which requires the Minister for Building and Construction to commission a review by 30 June 2018 as to whether a presumption that post-traumatic stress disorder is occupationally linked for relevant workers should be included into the Act. The provision requires the report to be tabled in both Houses of Parliament by 1 October 2018. Clause 6: Repeal of Act Repeals this amendment Act 365 days after it commences. Page 1 of 1
