CROWN LANDS (SHACK SITES) ACT 1997 (NO. 87 OF 1997) - SECT 34
Sale of shack site may involve strata plan
(1) The Minister may, pursuant to section 31(3) , prepare a strata
plan for and on behalf of the Crown if the Minister determines that it is
necessary or expedient to do so for the purposes of selling any shack sites
under this Act.
(2) Without limiting the Minister's discretion under subsection (1)
, the Minister may determine that a strata plan is required for the purpose of
affording common access, services or infrastructure for or in relation to a
group of shack sites.
(3) Subject to subsection (4) , a strata plan proposed under this
section may be lodged with the Recorder of Titles for registration in the same
manner as a plan prepared or lodged by a developer under Part XIA of the
Conveyancing and Law of Property Act 1884 .
(4) Notwithstanding section 75F of the
Conveyancing and Law of Property Act 1884 , a strata plan lodged by or on
behalf of the Minister under this section or an amendment to any such strata
plan, if lodged by or on behalf of the Minister, does not have to be submitted
to a council and does not require a council's certificate of approval.
(5) If satisfied that the requirements for registration have been
complied with, the Recorder of Titles must register the plan.
