VEHICLE AND TRAFFIC (VEHICLE OPERATIONS) NOTICE 2009 (S.R. 2009, NO. 91) - REG 28

Exemption of high-cube freight containers
(1)  For the purpose of this clause –
high-cube freight container means a box- like goods receptacle that –
(a) is constructed to a height of –
(i) 2.9 metres; or
(ii) 3.05 metres; or
(iii) 3.1 metres; or
(iv) 3.2 metres; or
(v) 3.3 metres; or
(vi) 3.45 metres; and
(b) has corner fittings of a type specified in, or similar to the types of corner fittings specified in, the Australian/New Zealand Standard AS/NZS 3711.3 entitled "Corner Fittings for Freight Containers" published by Standards Australia and Standards New Zealand on 25 October 1993, as amended or substituted from time to time.
(2)  Regulation 16(a) of the Vehicle Operations Regulations does not apply to a person using, or causing or permitting the use of, a vehicle, other than a dog trailer, that is carrying a high-cube freight container so long as the vehicle, inclusive of its load, does not exceed 4.5 metres in height.
