JUSTICE LEGISLATION MISCELLANEOUS AMENDMENT ACT 2018 (NO. 48 OF 2018) - SECT 93

In the notes at the foot of section 317AC of the Crimes Act 1958 —

        (a)     before note 1 insert —

"1AA         An offence against this section is a category 1 offence under the Sentencing Act 1991 if an emergency worker on duty, a custodial officer on duty or a youth justice custodial worker on duty is injured. See section 5(2G) of that Act for the requirement to impose a custodial order for this offence.";

        (b)     in note 2, after "discretion." insert "See also section 5(2G) of that Act.".
