(1) In this section
—
electronic means includes —
(a) an
electronic database or document system; and
(b) any
other means by which a document can be accessed electronically.
(2) The local
regulations may make provision for or in relation to the following —
(a) the
giving of a document required or permitted to be given under this Act or the
Legal Profession Uniform Law (WA) (including the giving of the document by
electronic means);
(b) the
time at which the document is taken to have been given;
(c) the
means of satisfying a requirement under this Act or the Legal Profession
Uniform Law (WA) in relation to a document in writing (for example, a
requirement that the original of a document be given or that a document be
signed) if the document is given by electronic means.
(3) This section
applies to a requirement or permission to give a document whether the term
“give”, “issue”, “send” or
“serve”, or any other similar term, is used.
(4) The local
regulations made under subsection (2) in relation to a document to which Legal
Profession Uniform Law (WA) Part 9.5 applies cannot provide for the document
to be given using a means provided for in that Part in a manner that is
inconsistent with that Part.
