ROAD TRAFFIC CODE 2000 - REG 254

254 .         Driving on nature strip

        (1)         A person must not drive a vehicle on a nature strip adjacent to a length of carriageway in a built‑up area, unless the driver is —

            (a)         entering or leaving, by the shortest practicable route, an area on the nature strip indicated by information on or with a road sign as an area where vehicles may drive; or

            (b)         driving on a part of the nature strip indicated by information on or with a road sign as a part where vehicles may drive; or

            (c)         driving on the nature strip to enter or leave, by the shortest practicable route, an area adjacent to a carriageway and there is not a part of the nature strip indicated by information on or with a road sign as a part where vehicles may drive; or

            (d)         driving a postal vehicle; or

            (e)         riding a bicycle, electric rideable device, motorised scooter or animal; or

            (f)         driving a ride‑on lawnmower that is cutting grass on the nature strip; or

            (g)         driving a motorised wheelchair; or

            (h)         permitted to drive, or park on the nature strip under a local law.

        Modified penalty: 2 PU

        (2)         A driver driving on a nature strip (except the rider of an animal) must give way to all other persons, and to animals, on the nature strip.

        Penalty:

            (a)         if offence committed by the driver of a motor vehicle other than a ride‑on lawn mower or motorised wheelchair —

                Points: 3         Modified penalty: 2 PU;

            (b)         otherwise —

                Modified penalty: 2 PU.
