ROAD TRAFFIC AMENDMENT ACT 2006 (NO. 54 OF 2006) - SECT 18

18 .         Section 67 amended

        (1)         Section 67(3)(a) is deleted and the following paragraph is inserted instead —


            (a)         for a first offence —

                  (i)         if the person has been previously convicted of an offence against section 64, to a fine of —

                        (I)         not less than the minimum fine that would apply if the offence were against that section instead of this section and the relevant percentage of alcohol in the person’s blood exceeded 0.14%; and

        (II)         not more than 50 PU,

                and, in any event, the court convicting that person shall order that the person be disqualified from holding or obtaining a driver’s licence for a period of not less than the minimum period of disqualification that would apply if the offence were against that section instead of this section and the relevant percentage of alcohol in the person’s blood exceeded 0.14%;

                  (ii)         in any other case, to a fine of not less than 16 PU or more than 50 PU; and, in any event, the court convicting that person shall order that the person be disqualified from holding or obtaining a driver’s licence for a period of not less than 6 months;

”.

        (2)         Section 67(4) is amended by deleting “ section 32 of the repealed Act or section 63 of this Act” and inserting instead —

                “ section 63 ”.
