Western Australian Numbered Acts Western Australian Numbered Acts Section 78A is
amended in the definition of “impounding offence (driver’s
licence)” by deleting all of the definition after “circumstances
in which —” and inserting instead —
“
(a) the driver had applied for the grant or renewal of a
driver’s licence and had been refused on a ground involving —
(i)
the driver’s addiction to alcohol or drugs; or
(ii)
another factor that affects, or is likely to affect, the
driver’s ability to control a motor vehicle;
(b) the
driver had held a driver’s licence that had been cancelled on a ground
described in paragraph (a); or
(c) the
driver held a driver’s licence the operation of which was suspended on a
ground described in paragraph (a);
”.
