(1) The amendments in
this Division are to the Fines, Penalties and Infringement Notices
Enforcement Act 1994 *.

(2) Section 26(2)
is repealed and the following subsection is inserted instead —
“
(2) If the alleged offence is under the Road Traffic
Act 1974 —
(a) the
payment of the whole or a part of the modified penalty and associated
enforcement fees in relation to a traffic infringement notice before an order
to pay or elect is made in respect of the notice; or
(b) the
making of an order to pay or elect in respect of a traffic
infringement notice,
constitutes a
conviction of the alleged offender for the alleged offence for the purposes of
section 51(1)(a) of that Act and, for the purposes of Part VIA of
that Act, the matter is to be treated as having been dealt with
by infringement notice when the payment or order is made.
”.
