Royal Commission

On August 11, 1987, the Prime Minister and the Minister for Aboriginal Affairs issued a joint statement to announce a Commonwealth and State Royal Commission to inquire into 'Aboriginal Deaths in Custody' since January 1, 1980.

The government also announced that a joint meeting of Commonwealth and State Ministers for justice will be held to 'discuss the brooder questions of Aboriginal/police relations and how these can be improved'.

The terms of reference and the appointment of a Royal Commission are still to be announced.

The AboriginalLB asked the Committee to Defend Black Rights to comment on the proposed Royal Commission.

Comment

The CDBR stressed that they strongly welcomed the Royal Commission. They considered that the proposed inquiry marks a recognition by the Federal Government that the criminal justice system isn't working for Aboriginal people.

However, before CDBR can pledge their complete support to such a Commission, they have asked that the government clarify certain issues.

Firstly, the CDBR questioned the role and power of a combined Federal and State Royal Commission in comparison to a State inquiry.

Secondly, CDBR asked that they be allowed to participate in the proposed discussions concerning the terms of reference and Commissioners.

Thirdly, the CDBR asked that an explanation be given as to the time period under review. They questioned the reasons behind limiting the period to 1980-1988.

Fourthly, the CDBR has specifically requested that Gerry Hand, the new Minister for Aboriginal Affairs, make funds available to Black families (affected by custodial deaths) to discuss the above mentioned issues.
