The Changing Face of Litigation

A research report by the Law and Justice Foundation of NSW gives an insight into the characteristics and experiences of people representing themselves in family law disputes, and what effect the phenomenon of unrepresented litigants has had on Family Court jurisprudence and procedure.

The research for The Changing Face of Litigation: Unrepresented Litigants in the Family Court was undertaken by Professor Rosemary Hunter, Dr Ann Genovese, April Chrzanowski and Carolyn Morris. The report includes a quantitative study that charts the growth of the number of unrepresented litigants between 1995 and 1999, and the characteristics of people who are unrepresented, partially represented or fully represented. As well, the report involves a qualitative study of 152 appeal cases heard in the Family Court in 1998-1999.
