CHILDREN AND YOUNG PEOPLE ACT 2008 - SECT 105

Escorting arrested person to court etc

    (1)     This section applies if an arrested person

        (a)     has not been released on bail; and

        (b)     is in police custody; and

        (c)     is required by law to be brought before a court or tribunal.

    (2)     A police officer may require an escort officer to bring the arrested person before the court or tribunal.

    (3)     The escort officer must bring the arrested person before the court or tribunal and, for that purpose, may—

        (a)     take the arrested person into custody; and

        (b)     arrange for the arrested person to be detained under this Act until the arrested person is brought before the court or tribunal.

    (4)     In this section:

"arrested person" means—

        (a)     a child or young person who is arrested; or

        (b)     someone else who is under 21 years old and is arrested in relation to an offence the person is alleged to have committed when under 18 years old.
