CHILDREN AND YOUNG PEOPLE ACT 2008 - SECT 323

Nature of disciplinary reviews

    (1)     To remove any doubt, a review is an administrative process.

    (2)     At a review—

        (a)     the rules of natural justice apply; and

        (b)     the laws of evidence do not apply; and

        (c)     evidence must not be given on oath or by affidavit; and

        (d)     the question whether a young detainee has committed a behaviour breach must be decided on the balance of probabilities.
