(1) A person commits an offence if the person—
(a) breeds a dog or cat; and
(b) does not hold a breeding licence.
Maximum penalty: 50 penalty units.
(2) A person commits an offence if the person—
(a) sells or gives away a dog or cat; and
(b) does not give the buyer or recipient of the dog or cat—
(i) if the person holds a breeding licence—the person's breeding licence number; or
(ii) in any other case—the person's rehoming identifier and the unique identifier from the dog or cat's microchip.
Maximum penalty: 50 penalty units.
(3) A person commits an offence if the person—
(a) publishes a statement that either—
(i) constitutes an invitation to buy or otherwise acquire a dog or cat from the person; or
(ii) could reasonably be understood to constitute an invitation to buy or otherwise acquire a dog or cat from the person; and
(b) does not include in the publication—
(i) if the person holds a breeding licence—the person's breeding licence number; or
(ii) in any other case—either the person's rehoming identifier or the unique identifier from the dog or cat's microchip.
Maximum penalty: 10 penalty units.
(4) An offence against this section is a strict liability offence.
(5) In this section:
"rehoming identifier", of a person, means—
(a) if a person has an identifier for rehoming a dog or cat under the law of a State—the person's identifier; or
(b) in any other case—either of the following:
(i) if the person has an ABN—the person's ABN;
(ii) if the person does not have an ABN—the person's name.
