ENVIRONMENT PROTECTION ACT 1997 - SECT 91A

Definitions for div 9.5

    (1)     In this division:

"approved use", in relation to land, means use—

        (a)     that is consistent with the national capital plan or the territory plan

, as the case requires; and

        (b)     for leased land—that is permitted by the lease.

"national environment protection measure" means a national environment protection measure made under the National Environment Protection Council Act 1994

, section 13 (1) as in force from time to time.

"substance" includes matter or thing.

    (2)     For this division, an environmental audit for assessment or remediation of contaminated land is an audit by an auditor—

        (a)     that relates to an assessment or remediation carried out (whether under this Act or otherwise) in relation to actual or possible contamination of land; and

        (b)     that is conducted for the purposes of deciding 1 or more of the following:

              (i)     the nature and extent of the assessment or remediation undertaken;

              (ii)     the nature and extent of any contamination or remaining contamination of the land;

              (iii)     if the land is suitable for a specified use or range of uses, having regard to any contamination or remaining contamination of the land;

              (iv)     what further assessment or remediation is necessary before the land is suitable for any specified use or range of uses;

              (v)     the appropriateness of any remediation plan, long-term management plan, assessment proposal or remediation proposal.
