(1) An offence is an "indictable offence" if—
(a) it is punishable by imprisonment for longer than 2 years; or
(b) it is declared by an ACT law to be an indictable offence.
(2) An "indictable offence" includes an indictable offence that is or may be dealt with summarily.
(3) Any other offence is a summary offence and is punishable on summary conviction.
