MEDICINES, POISONS AND THERAPEUTIC GOODS ACT 2008 - SECT 187

Regulations—records kept electronically

    (1)     If a document that is required to be kept under this Act is kept in electronic form, a regulation may require that the electronic form of the document be recorded or retained on a particular kind of data storage device.

    (2)     Subsection (1) applies despite the Electronic Transactions Act 2001

, section 11 (1) (c) and (2) (d) (Retention of information and documents).

Note     Section 11 (1) (c) and (2) (d) provide for regulations under the Electronic Transactions Act 2001

to prescribe data storage devices.

    (3)     For the Electronic Transactions Act 2001

, a regulation under subsection (1) is taken to be a regulation under that Act.

    (4)     In this section:

"data storage device"—see the Electronic Transactions Act 2001
