RESIDENTIAL TENANCIES ACT 1997 - SECT 11AA

Advertising—false or misleading required information

    (1)     A person commits an offence if—

        (a)     the person publishes an advertisement for the lease of premises; and

        (b)     the advertisement includes the required information; and

        (c)     the required information is false or misleading.

Maximum penalty: 5 penalty units.

    (2)     Subsection (1) does not apply if the person has a reasonable excuse.

Note     The defendant has an evidential burden in relation to the matters mentioned in s (2) and s (3) (see Criminal Code

, s 58).

    (3)     Also, subsection (1) (c) does not apply if the information is not false or misleading in a material particular.

    (4)     An offence against this section is a strict liability offence.

    (5)     In this section:

"required information"—see section 11A (4).
