DENTISTS ACT 1931 (REPEALED) - SECT 3

Interpretation for Act

    (1)     In this Act:

Note     A definition applies except so far as the contrary intention appears (see Legislation Act 2001 , s 155).

"board" means the Dental Board established by section 6.

"chairperson" means the chairperson of the board.

"dental service" includes a dental operation, attendance or advice.

"deputy chairperson" means the deputy chairperson of the board.

"member" means a member of the board.

"Mutual Recognition Act" means the Mutual Recognition Act 1992 (Cwlth).

"registered" means registered under this Act as a dentist, specialist dentist or dental hygienist.

"registered dental hygienist" means a person—

        (a)     who is registered as a dental hygienist under this Act; or

        (b)     who is to be deemed to be registered as a dental hygienist under this Act because of the Mutual Recognition Act, section 25.

"registered dentist" means a person—

        (a)     who is registered as a dentist under this Act; or

        (b)     who is to be deemed to be registered as a dentist under this Act because of the Mutual Recognition Act, section 25.

"registered specialist dentist" means a person—

        (a)     who is registered in a specialist branch of dentistry under this Act; or

        (b)     who is to be deemed to be registered in a specialist branch of dentistry under this Act because of the Mutual Recognition Act, section 25.

"registration authority" means a person or body empowered by a law of a place outside the ACT to register dentists or dental hygienists or otherwise authorise persons to practise as dentists or dental hygienists.

"specialist branch of dentistry" means 1 of the following:

        (a)     dento maxillofacial radiology;

        (b)     endodontics;

        (c)     oral and maxillofacial surgery;

        (d)     orthodontics;

        (e)     paediatric dentistry;

        (f)     periodontics;

        (g)     prosthodontics;

        (h)     any other prescribed branch of dentistry.

    (3)     For this Act a person shall be deemed to practise dentistry if—

        (a)     the person practises dentistry personally on his or her own account or as a member of a firm; or

        (b)     in the course of a business carried on by him or her, a person or persons employed by him or her is or are engaged in the practice of dentistry; or

        (c)     the person is engaged in the practice of dentistry as a person employed in a business carried on by another person or by a firm.
