Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) A determination made under subsection 445(1) or a direction given under subsection 446(1) must not require an individual to be subject to a biosecurity measure of a kind set out in Subdivision B of Division 3 of Part 3 of Chapter 2 (biosecurity measures that may be included in a human biosecurity control order).
(2) However, subsection (1) does not prevent an individual being required, during a biosecurity emergency period, to wear specified clothing or equipment (or both) that is designed to prevent a disease or pest from establishing itself or spreading.
Note: For example, a requirement to wear such clothing or equipment when entering or leaving specified places could be determined under subsection 445(1), as referred to in paragraph 445(3)(a).
(3) To avoid doubt, subsection (1) does not affect the
powers of the Director of Biosecurity or a biosecurity officer under
Subdivision B of Division 2 of Part 4 of Chapter 10
(decontamination) during a biosecurity emergency period.
