(a) expressly by the terms of the lease; or
(b) by implication from the terms of the lease; or
(c) otherwise (including expressly, or by implication, from the operation of legislation).
Example of implication from legislation
(2) An example of a thing permitted by implication from the
operation of legislation is where the legislation states that, if a lease is
not renewed, compensation is payable for any building constructed on the land
subject to the lease. The construction of the building is permitted by
implication from the statement.
