ABORIGINAL AND TORRES STRAIT ISLANDER COMMISSION ACT 1989 No. 150 of 1989 - SECT 196
Review by Administrative Appeals Tribunal
196. (1) An application may be made to the Administrative Appeals Tribunal for
review of:
(a) a decision made by the Commission to refuse a loan under section 16 or
17 to a natural person;
(b) a decision made by the Commission to refuse to give a guarantee under
section 19 in respect of a loan made or to be made to a natural
person;
(c) a decision made by the Commission to give notice to a person or body
under subsection 20 (1) or (3);
(d) a decision of the Commission under subsection 89 (2) refusing to
declare a body corporate to be an Aboriginal or Torres Strait Islander
corporation;
(e) a decision of the Commission under subsection 89 (3) declaring that a
body corporate has ceased to be an
Aboriginal or Torres Strait Islander corporation;
(f) a decision of the Commission to make a declaration under
subsection 121 (1);
(g) any other decision of the Commission included in a class of decisions
declared by the regulations to be reviewable decisions for the
purposes of this section; or
(h) any decision made under the Regional Council election rules or the
zone election rules included in a class of decisions declared by the
regulations to be reviewable decisions for the purposes of this
section.
(2) Where the Commission notifies a person of a decision of a kind referred to
in subsection (1), the notice shall include a statement to the effect that,
subject to the Administrative Appeals Tribunal Act 1975, application may be
made to the Administrative Appeals Tribunal for review of the decision by or
on behalf of a person whose interests are affected by the decision.
(3) A failure to comply with subsection (2) in relation to a decision does not
affect the validity of the decision.
(4) In this section:
"decision made by the Commission" does not include a decision made by a
delegate of the Commission.
