(1)

A Commissioner is to be appointed by the Minister by written instrument.

(2)

The appointment:

(a) is to be on a full-time basis for the ABC Commissioner; and
(b) is to be on a full-time basis or part-time basis for a Deputy ABC Commissioner.

(3)

The Minister must not appoint a person as a Commissioner unless the Minister is satisfied that the person:

(a) has suitable qualifications or experience; and
(b) is of good character.

(4)

A Commissioner holds office for the period specified in the instrument of appointment. The period must not exceed 5 years.

(5)

A Commissioner holds office on the terms and conditions (if any) in relation to matters not covered by this Act that are determined by the Minister.
