BOUNTY AND SUBSIDY LEGISLATION AMENDMENT ACT (No. 2) 1986 No. 119 of 1986 - SECT 17

Overpayments of bounty, &c., because of this Act
17. (1) Where, because of an amendment of an Act made by section 15, the
amount paid to a person by way of bounty or subsidy under that Act before the
day on which this Act received the Royal Assent exceeds the amount of bounty
or subsidy which that person was entitled to be paid before that day under
that Act as so amended, the person is liable to repay to the Commonwealth the
amount of the excess.

(2) Where a person is liable to repay an amount to the Commonwealth under
sub-section (1), the Commonwealth may recover that amount as a debt due to the
Commonwealth by action in a court of competent jurisdiction.

(3) Where a person is liable to repay an amount to the Commonwealth under
sub-section (1), that amount may be deducted from any other amount that is
payable to the person under an Act providing for the payment of bounty or
subsidy and, where the first-mentioned amount is so deducted, the other amount
shall, notwithstanding the deduction, be deemed to have been paid in full to
the person.
