BARLEY RESEARCH ACT 1980 No. 168 of 1980 - SECT 23

Constitution of State Committees
23. (1) A State Committee-

   (a)  shall consist of such number of members as is agreed upon from time to
        time between the Minister and the appropriate Minister of the State
        concerned; and

   (b)  shall be appointed by the Minister from persons nominated by the
        appropriate Minister but so that a majority of the members of the
        Committee shall be persons who are members of, and have been nominated
        to the appropriate Minister by, an organization or organizations in
        the State affiliated with the growers organization.

(2) Subject to sub-section (3), the members of a State Committee hold office
during the pleasure of the Minister.

(3) If a member of a State Committee fails, without reasonable excuse, to
comply with his obligations under section 29, the Minister shall terminate the
appointment of the member.

(4) The appointment of a member of a State Committee is not invalidated and
shall not be called in question by reason of a defect or irregularity in
connection with his nomination or appointment.

(5) The exercise of a power or the performance of a function by a State
Committee is not invalidated by reason of there being a vacancy or vacancies
in the membership of the Committee.
