Commonwealth Electoral Legislation Amendment Act 1983 No. 144 of 1983 - SECT 39

39. Section 55 of the Principal Act is amended-

         (a)  by omitting from sub-section (1) ''When'' and substituting
''Subject to sub-section (3), where''; and

   (b)  by omitting sub-sections (2) and (3) and substituting the following
        sub-sections:

''(2) Notice under sub-section (1) shall be in the approved form and may be
given to the person objected to by being posted to-

   (a)  in a case where the person objected to has notified, in writing, the
        Divisional Returning Officer for the Division for which he is enrolled
        of an address to which notices may be given to him-the address so
        notified;

   (b)  in a case where paragraph (a) does not apply to the person objected to
        and the place of living of the person objected to is known to the
        person giving the notice-the place of living of the person objected
        to; or

   (c)  in any other case-the place of living of the person objected to as
        appearing on the Roll.

''(3) Where the Divisional Returning Officer is satisfied that an objection is
frivolous or vexatious, he may dismiss the objection without giving notice of
objection to the person objected to.''.
