DISABILITY DISCRIMINATION ACT 1992 No. 135 of 1992 - SECT 49

49.(1) This Part does not:

   (a)  affect a provision in a charitable instrument that confers charitable
        benefits, or enables charitable benefits to be conferred, wholly or in
        part on persons who have a disability or a particular disability; or

   (b)  render unlawful any act done to give effect to such provision.

(2) In this section:

"Australia" includes the external Territories;

"charitable benefits" means benefits for purposes that are exclusively
charitable according to the law in force in any part of Australia;

"charitable instrument" means a deed, will or other document, whether made
before or after the commencement of this Act, that confers charitable benefits
or enables charitable benefits to be conferred on persons.
