DAIRY INDUSTRY ASSISTANCE ACT 1977 No. 54 of 1977 - SECT 10

10. (1) Where any levy has been overpaid, the amount overpaid shall be
refunded by the Commonwealth.

(2) Where-

   (a)  an amount is to be refunded by the Commonwealth in accordance with the
        Levy Act or with sub-section (1) of this section; and

   (b)  that amount has been taken into account in calculating an amount to be
        paid into the Account under paragraph 12 (a), the amount of the refund
        shall be paid from the Account.
